Why the Hell should a black man be treated differently from a white man? This sentencing madness is discrimination in its purest form – Carole Malone

So this week a group of unelected people are about to change how our justice system works.

The group – which calls itself The Sentencing Council and is made up of eight members of the judiciary and six others – is about to give a free pass on bail, prison AND punishments to all ethnic minorities, trans people and a few women.

Everyone else – and there’s really only white British men left – will face the full force of the law. So, as of this week, it’s official.

We now have one (soft) law in this country which will prioritise black, brown and trans people and another harsher one for everyone else.

How can that be possible in a Christian country where 82 per cent of the population is white?

The Sentencing Council is telling judges and magistrates to prioritise ethnic minorities, trans people and some women in considering bail because the poor lambs may be at a “disproportionately higher risk” if they are remanded in custody.

And what about the people who’ll be at risk if they are NOT remanded in custody. Or don’t victims of crime matter in this country any more?

And isn’t the logic of these new guidelines that these people will never be sent to jail for anything because of the risk?

The Sentencing Council believes that people of colour may have suffered trauma because of trauma originally inflicted on their ancestors in the slave trade 300 odd years ago.

So from now on a black yob from Tower Hamlets who’s a serial robber and who hurts people can claim he did it because he’s been traumatised by what happened to his black ancestors 300 years ago even though he hasn’t a clue who they were or what happened to them.

And that “trauma” will get him off with a suspended jail sentence or no sentence at all while a white robber who has done the same thing will go down for a five year stretch?

Keir Starmer keeps insisting there’s no such thing as Two Tier Justice in this country yet here’s a perfect example of it.

And this justice is being wielded by a group of unelected judges who think they know what’s best for the British people, a group it appears Keir Starmer has no power over because he’s already told them to reconsider their new guidelines – and they’ve said no.

They’ve also told our Justice Secretary, Shabana Mahmood, to go hang as well. She’s (supposedly) told them to ditch the guidelines because they’ll lead to offenders being treated differently because of the colour of their skin – and they’ve ignored her too!

Why should a trans person be handed a Get Out Of Jail Free card when a non-trans person isn’t? And just imagine how many people will suddenly identify as trans if they think it’s going to get them off a jail sentence.

Everyone has suffered some kind of trauma which may or may not have led to them offending. But the only people who will have that taken into account are black, brown and trans people and a few women.

This week Shabana Mahmood is expected to introduce emergency legislation to block these new guidelines and she will also consider laws to reform the powers of the Sentencing Council.

I’ll believe that when I see it!

Because from the day this Government came to power it has presided over, and pushed for, a two tier justice system here in Britain. So, the idea that Starmer and Mahmood vigorously object to what the Sentencing Council is doing is hard to believe because it seems to be doing exactly what the two of them want.

And if the Sentencing Council (SC) is part of the Ministry of Justice why is it ignoring the Justice Minister? Is it controlling her? Or is she the boss? Because from where we’re all sitting it’s the SC is giving the orders not Ms Mahmood.

I’d like to see her and Starmer prove me wrong and disband this insidious council which looks determined to divide the country on the basis of skin colour and gender.

Because simply reforming it can never be enough if its core belief is that justice should be meted out on the colour of a person’s skin. Because that’s surely racist?

Violence is violence whether its perpetrated by a black, brown or white man. Rape is rape whether its committed by a black, white or brown man. As is murder, as is drug dealing. And the rape victims, the murder victims’ families and the victims of violence don’t give a toss that the people who wrecked their lives might have had slave ancestors and be suffering trauma.

Does no-one care about the trauma these criminals have inflicted on totally innocent people?

And since when did any Government with an ounce of backbone allow an unelected body like the Sentencing Council to change the laws of the land to make them favourable to one group of people and unduly harsh on another?

That’s discrimination in its purest form. And it’s discrimination largely based on skin colour.

Starmer, of course, is doing what he always does in situations he can’t handle – he’s blaming the Tories saying these guidelines first originated under David Cameron’s government.

Yes, well his government never implemented them. Nor has any Tory Government since. He’s PM now and it’s in his power to fix this – so why isn’t he?

And is Starmer really saying he can’t overturn something previous governments started? Because he had no problem ditching the Rwanda scheme within days of coming into office.

The British legal system used to be regarded as one of the best and most independent in the world. Not any more. It seems to be being run by a bunch of people who care only about the best interests of ethnic minorities and trans people – not the majority!
